Certified copies of electronic records
Notarized a document online and now need a paper version your county recorder will accept? We coordinate California’s disinterested custodian process under Government Code section 27201.1.
A document notarized through remote online notarization is an electronic record, and a county recorder generally needs a paper version. California’s disinterested custodian process (Government Code section 27201.1, added by AB 2004, effective January 1, 2025) provides a way to create one.
The process at a glance
The custodian signs a certification under penalty of perjury, before a notary, stating that:
Tell us about the recorded document and the electronic record it came from, such as a document notarized through remote online notarization.
A disinterested custodian with access to the electronic record is lined up. They must not be a grantee, beneficiary or other person who directly benefits from the document.
The custodian prints the record, or has it printed under their supervision, and signs a certification under penalty of perjury before a notary, who completes a jurat.
You receive the printed copy with the signed and notarized certification attached, ready to submit to the county recorder.
It applies to instruments or notices that are authorized or required to be recorded.
The notary completes a jurat only. The notary does not certify the copy or confirm the custodian is disinterested.
This is separate from a certified copy issued by a county recorder, and the certification must use the form prescribed by the statute.
Signing Collective coordinates the custodian and notary appointment. We are not a law firm and cannot advise whether your document qualifies for recording or whether a particular recorder will accept it. Please confirm requirements with your county recorder, title or escrow company, or attorney before booking.
County recorders generally record paper instruments. If your document was signed and notarized electronically, this process creates a certified paper version from the electronic record.
A person with access to the electronic record who is not a grantee, beneficiary or other person who directly benefits from it. We coordinate this step for you.
No. The custodian certifies the copy. The notary verifies the custodian’s identity, administers the oath and completes a jurat.
